In part one of this lengthy podcast, Harrison Weinhold stops by to talk about the very eventful week in Supreme Court news, as he and Tom talk constitutional theory, how Supreme Court opinions, whether “liberal” or “conservative,” read more and more like campaign speeches or legislative debates all the time, and what the future of contentious issues like same-sex marriage might be. Highlights include Harrison suggesting that Tom should be a Supreme Court justice, an incredibly unlikely proposition to which Tom quickly and wholeheartedly agrees. Tom also elaborates and clarifies the judicial philosophy of the sometimes-maligned Antonin Scalia. Harrison and Tom go on to discuss the George Zimmerman trial in Florida, then take an inevitable detour into the Redskins nickname controversy and how that topic fits into broader notions of free speech in an open society.
